Hulk Hogan vs Gawker continued in court this past Thursday, as Hogan’s attorneys attempt to claim the $115 million in compensatory damages and another $25.1 million in punitive damages awarded to Hogan back in March of this year.
According to The Tampa Bay Times, Pinellas-Pasco Circuit Judge Pamela Campbell ruled this past Thursday that Hogan is entitled to former Gawker editor A.J. Daulerio’s indemnity rights, as Daulerio is the only person involved in the case who has yet to file for Chapter 11 bankruptcy. Both Gawker and Gawker founder Nick Denton have filed for Chapter 11, which protects them from having their assets seized.
This past Thursday, Hogan’s attorneys asked that Daulerio’s assets be further investigated, as they previously accused Daulerio of withholding the extent of his indemnification rights and thus misrepresenting his assets. As of Monday, Daulerio had just $1,505.78 in his checking account, but with the judge ruling that Hogan is entitled to Daulerio’s indemnity rights, it could be enough money to cover the entire judgment.
The judge has scheduled a hearing on Hogan’s renewed motion for sanctions against Daulerio, and that will take place on October 31st. By the end of next week, Daulerio will be deposed on his current financial situation, and if more assets are discovered in the deposition process, Hogan’s attorneys will likely ask that they be seized immediately.
